These Terms and Conditions apply to all quotations, bookings, and works carried out by Lally Fencing (“the Company”) for any customer (“the Customer”). Acceptance of any quotation or commencement of works constitutes acceptance of these Terms and Conditions.

1.1 Acceptance of a quotation, whether verbally or in writing, confirms the Customer’s agreement to these Terms and Conditions.
1.2 No contract exists until the quotation has been accepted by the Customer.

2.1 All quotations are valid for 30 days from the date of issue unless otherwise stated in writing.
2.2 The Company reserves the right to amend quotations after this period due to changes in material or labour costs.

3.1 The Company will carry out the works as described in the accepted quotation.
3.2 Any additional work requested by the Customer that falls outside the original scope may incur additional charges, which will be agreed in writing before proceeding.

4.1 The quotation is based on the ground conditions visible at the time of survey and the information provided by the Customer.

4.2 The Customer must inform the Company in writing prior to commencement of any known or suspected underground obstructions or services, including but not limited to:

• Electrical cables
• Gas pipes
• Water pipes
• Drainage
• Large tree roots
• Buried concrete or debris

4.3 If unforeseen ground conditions are encountered (including but not limited to concrete, large rocks, tree roots, buried obstructions, or excessive debris), or if additional waste removal is required beyond that originally discussed, this may result in additional costs. The Company will pause work and agree any such costs with the Customer in writing before proceeding.

4.4 The Company will take reasonable care when excavating or installing posts. However, the Company shall not be held liable for any damage to underground cables, pipes, or services that were not clearly identified, marked, or disclosed in writing by the Customer prior to the commencement of works.

5.1 Payment is due in full upon completion of the works and on receipt of invoice, unless otherwise agreed in writing prior to commencement.

5.2 Accepted payment methods include:

• Bank transfer
• Cash
• Card payment (where available)

6.1 If payment is not received within 7 days of the invoice date, the Company reserves the right to:

• Apply a late payment fee of £25, and/or
• Charge interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998 (where applicable).

7.1 For larger projects, the Company may require a deposit of 30–50% of the total quoted amount prior to commencement.
7.2 The remaining balance will be payable upon completion of the works.

8.1 If a confirmed booking is cancelled within 48 hours of the scheduled start date, a cancellation fee may apply to cover time and incurred expenses.
8.2 If the Customer requests a postponement, a new date will be arranged subject to availability.

9.1 Any waste removal included in the quotation will be disposed of responsibly.
9.2 Additional waste beyond that originally agreed may incur further charges.

10.1 The Company holds £5 million Public Liability Insurance . Proof of insurance is available upon request.
10.2 The Company is not responsible for pre-existing damage, structural defects, or subsidence affecting fencing installations.

11.1 All materials supplied remain the property of Lally Fencing until full payment has been received.

12.1 The Company guarantees workmanship for 12 months from the date of completion, subject to:

• Fair wear and tear
• Proper use and maintenance of the fencing
• No damage caused by storms, accidents, or third parties

12.2 This warranty does not cover natural timber movement, warping, or colour changes, which are inherent characteristics of wood.

13.1 The Customer agrees to provide safe, reasonable, and clear access to the work area.

13.2 If restricted access, obstacles, or unsafe conditions prevent or delay work, the Company reserves the right to:

• Pause works until access is resolved, and/or
• Charge additional costs for delays or extra labour required.

14.1 Works may be delayed or rescheduled due to adverse weather conditions, including (but not limited to) heavy rain, frost, high winds, or extreme heat.

14.2 The Company will make reasonable efforts to complete works as soon as conditions allow.

15.1 In the event of any dispute, both parties agree to attempt resolution through open communication before pursuing further legal action.

16.1 The Company will store and use Customer information solely for the purpose of providing services and will not share personal data with third parties without consent, except where required by law.
